Premier L i Keqiang Vows to Conduct Pilot Integrated Management of IP
On March 5th, the 5th Session of the 12th National People's Congress opened at the Great Hall of the People in Beijing. On behalf of the State Council, Premier Li Keqiang delivered the report on the work of the government. He said "we will continue piloting reforms for all-around innovation.
We will begin piloting reforms to conduct integrated management of intellectual property rights and improve the system for creating, protecting, and applying intellectual property rights as well as work faster to improve the property rights protection system."
Supreme Court Rolls out Guiding Cases
To make clear judicial rules and unify standards, the Supreme People's Court has released a new batch of guiding cases, all involving intellectual property disputes. It is the first time for the court to roll out such cases in a particular field, Guo Feng, deputy director of the research office at the court, said at a news conference on March 9. Since the first release in December 2011, the court has announced 87 guiding cases. IP cases accounted for nearly 23 percent of the total, including 10 released in the latest batch.
Policy Released to Address Counterfeits
The State Council has released a new policy to crack down on intellectual property infringement. Targeted at cross-regional and organized illegal businesses, the new policy calls for increasing fight against the production, distribution and sale of counterfeit goods. The efforts will include implementing new technologies, including big data and cloud computing, to enhance market supervision and inspection, and improved coordination between legal and administrative agencies. The policies will also advance the credit system and facilitate cooperation in IP protection overseas.
Nine Ministries Jointly Released the Opinions on Further Implementing IPR Strategy in Northeast China
On March 28, nine ministries, including the State Intellectual Property Office, the National Development and Reform Commission, the Ministry of Science and Technology and etc., jointly issued Opinions on Further Implementing IPR Strategy in Northeast China to Support the Comprehensive Revitalization of Old Industrial Base in Northeast China. The Opinions raised key tasks in the following aspects: enhance the ability of IPR creation and utilization; promote IPR transfer, transformation and protection; make IPR play the supporting and leading role; promote the upgrading of industrial structure; strengthen the guidance for IPR in different sectors etc.
Zhang Maoyu Met IPR Delegation from Denmark
On April 5, Zhang Maoyu, vice president of the State Intellectual Property Office (SIPO), met Jesper Kongstad, president of Danish Patent and Trademark Office who led the Danish IPR delegation. Zhang expressed that in recent years, China and Denmark had scored achievements in the fields of patent examination operations and patent prosecution highway. He hoped that both parties could continue to strengthen their cooperation in aspects of IPR legal polices, IPR creation and protections as well as patent examination operations to promote the in-between and in-depth innovative cooperation.
China and Australia Signed MoU on IPR Cooperation
On March 23, the Memorandum of Understanding between the State Intellectual Property Office of PRC and Intellectual Property Australia was signed during the period when Premier Li Keqiang visited Australia to continue to strengthen both parties’ cooperation and exchanges in the fields of patent examination, literature exchanges and public services.
The signing of the MoU further consolidated the friendly dialogue, exchanges and cooperation in the fields of IPR between China and Australia. It would be conducive to building positive IPR environments for cordial exchanges in the fields of economy and culture between two countries.
Advancing Legal Amendments to Protect Patent Rights
On March 12th, as State Intellectual Property Office (SIPO) Commissioner Shen Changyu answered a reporter's question during the time of Minister's Passage in the Great Hall of the People, he stated that this year significant efforts shall be put forth in order to ensure proper legal amendments to patent laws. Reforms shall be carried out to tackle current problems in the protection of patent rights such as proof-providing difficulties, long periods, high costs, low compensations and deficient results.
