"Genuine and Fake Polo" five years of trademark infringement disputes: "Guangzhou Polo" was ruled of invalid trademark

The "Genuine and Fake POLO" trademark infringement dispute case, which lasted more than five years, has made new progress recently.

On July 29, 2021, according to the second-instance judgment made by the Beijing Intellectual Property Court, regarding Guangzhou Ai Chi Company sued Ralph Lauren Trading (Shanghai) Co., Ltd., Beijing Scitech Department Store Co., Ltd., and Beijing Hualian (SKP) Department Store Co., Ltd. violated its category 18th "POLO" and "POLO GOLF", and category 25th "POLO" trademark dispute. Ralph Lauren's use of the "POLO" and "POLO RALPH LAUREN" logos on backpacks and accessories would not confuse the relevant public about the source of the goods or misunderstand. It did not infringe on the exclusive right of the trademark of Ai Chi Company in the case.

Therefore, the second-instance judgment annulled the first-instance ruling and rejected Ai Chi's litigation request.
