The second meeting of the Second Standing Council of the Beijing Intellectual Property Law Society (the Society) was held in Beijing on June 16. To improve the professional committee system of the Society, the meeting announced the establishment of the Copyright Law Professional Committee and Competition Law Professional Committee and the composition of both committees. The establishment of both committees will give the Society more access and resources to research popular and challenging issues of copyright and competition law in depth, improve the professional institutions' layout within the Society, and enhance the professional ability of the Society itself.
With the theme of "the Related Issues of the Management of Copyright Collective", representatives from the five collective copyright management organizations—China Written Works Copyright Society, Music Copyright Society of China, China Audio-Video Copyright Association, Images Copyright Society of China and China Film Copyright Association—shared their thoughts and ideas along with government officials, experts, judges, lawyers, business representatives and users.
As a professional academic institution in the IP field, the Society has always focused on the hot issues at the forefront of the industry and highlighted its professional characteristics. This meeting emphasizing on the relevant legal issues of copyright collective management, is conducive to participants to better understand the system construction and value foundation of copyright collective management, is of great significance for promoting the exchange between copyright collective management organizations and the industry, and is useful for the soundness and perfection of copyright protection mechanism.
The professional committees are the internal bodies established by the Society. To standardize management and improve quality, the second session of the first general meeting of the Society has specially formulated the rules for the operation of professional committees. Under these rules, the Society has already established three professional committees: the Enterprise IP Professional Committee, the Trademark Law Professional Committee, and the Patent Law Professional Committee.
The recent establishment of the Copyright Law Professional Committee and the Competition Law Professional Committee are of great importance for improving the internal structure of the Society, strengthening the Society's in-depth research in the IP field, creating a first-class platform for exchange of IP theory and practice, and enhancing the research Society's own professional competence.
To further the understanding of the layout of the Society and its future plans, China IP interviewed Qu Sanqiang, executive vice president of the Society, Yang Huaquan, vice president and secretary-general of the Society, Liu Ying, director of the Copyright Law Professional Committee, and Yin Fenglin, director of the Competition Law Professional Committee.
Q: Can you briefly introduce what are the five professional committees' positioning?
Yang Huaquan: Enterprise IP Professional Committee, Trademark Law Professional Committee, Patent Law Professional Committee, along with our newly-established Copyright Law Professional Committee and Competition Law Professional Committee, almost complete the Society's layout. The Enterprise IP Professional Committee was established the earliest and focused on the management and application of enterprises. It can uniquely and comprehensively promote the communication and cooperation among judicial personnel, enterprise IP management personnel, and legal personnel. The other four professional committees were established according to a specific IP field.
The establishment of five professional committees indicates that the Society's job will be enriched, and our professional work will be more systematic and comprehensive. So I think this is a good thing.
Q: Why would the Society make such a layout consideration?
Qu Sanqiang: Since the founding of the Society, there has always been such a layout consideration that when the time is right, the Society would establish different professional committees. The Enterprise IP Professional Committee aims to provide enterprises training, service, advice about IP management and protection.
Such layout tremendously increases the efficiency of the Society without wasting too many resources now that the professional committees can work with specific targets more flexibly and conveniently.
Now it's only a start for these five professional committees after we adjust and perfect the construction and mechanism, our next step would be to host more activities with extra focus and emphasis.
Q: What's the Society's plan for the second half of 2019?
Yang Huaquan: There could be a large event happening at the end of 2019. Other than that, the five professional committees will also hold several events according to their focus, including social research, case study, participation in the legislation, etc. With the expansion of influence in all aspects, the Society will uphold a neutral attitude to timely acknowledge the problems that emerged from the interaction process with our members, to make future activities more specific and unequivocal.
Qu Sanqiang: Each professional committee will have their intrinsic plans. For example, the Patent Law Professional Committee and Trademark Law Professional Committee will conduct more case studies; The Enterprise IP Professional Committee will be more concentrated on social research. There will be a variety of activities happening for the second half of 2019, and there will be multiple forums hosted by each professional committee with their designated topics.
Q: Any advice on the professional committees' future directions?
Qu Sanqiang: Each member of the professional committees were carefully selected and suitable for their jobs, covering a range of enterprises specialists, academics, lawyers, and judges. At present, the development of China's intellectual property rights (IPR) is on the cusp of changing global climate, putting IPR under the spotlight. For us who are engaged in the IP industry, this is not only a challenge but a better opportunity. We can give suggestions and contribute to such circumstance; there are many things we need to do for the IP industry.
Q: What's the significance behind the establishment of the Copyright Law Professional Committee?
Liu Ying: It is significant in that first it has to expand the scale and impact of the Society. Copyright is closely related to cultural and technological development, and with the rapid growth of technologies, relevant issues are emerging, such as artificial intelligence (AI) and copyright collective management. New technologies and new business modes confer multiple tasks to copyright. Thus, we will conduct in-depth research based on the third provision of the Copyright Law and host relative seminars, salons, round table meeting, and internal discussions.
Q: Will there be any cooperation between the Copyright Law Professional Committee and other professional committees?
Liu Ying: Of course. All the professional committees are interconnected. For example, AI occupies a hot topic in patent law; copyright covers the brand development of the culture industry, which is related to trademark as well. Other than internal cooperation, we will seek for outside collaboration too. I work at China University of Political Science and Law, and we just launched an IP Alumni Summit with hundreds of participants.
I have full confidence in the future of the Copyright Law Professional Committee, and I am sure it will become a professional committee with its characteristics and brand influence.
Q: What is the future plan for Competition Law Professional Committee?
Yin Fenglin: The Competition Law Professional Committee is focusing on three areas. First, we will strengthen communication and exchanges with practitioners, law firms, courts, universities to construct a platform of communication and collaboration in Beijing. Second, we will host more seminars to further the discussion and research of particular cases. Last, when the time is right, we will publish a "reasonable competition guide" for specific industries. Besides, we will team up with other professional committees to work in a synchronized pace, especially in the interdisciplinary fields.
In the future, our committee would like to build a platform to further the exchange, practice and research relying on the professional resources of Beijing and the Society. We sincerely hope that such a platform can steadily build certain international impact on the communication, practice and research of competition law.
